This User Agreement ("Agreement") is concluded between 593 DİJİTAL PAZARLAMA VE YAZILIM Ltd. Şti (hereinafter referred to as "Infofluencer"), located at "15 Temmuz Mah. Papatya Sok. c5-1 Block no: 4 Interior door no: 4 Esenler/Istanbul", and the member ("Member") of the infofluencer.co website ("Site"), under the conditions set forth below.
1. COMMENCEMENT, PURPOSE AND SCOPE OF THE AGREEMENT
In accordance with the principles set forth in this Agreement, Infofluencer analyses Influencers' social media data — Meta (Instagram / Facebook Graph API), Google Analytics 4, TikTok API, YouTube Data & Analytics API — and showcases its members for commercial purposes through a paid subscription model on the Site.
After completing the registration process on the Site, the Member may begin using the Site by entering their first name, last name, email address and password, provided that they comply with the conditions specified in this Agreement.
If the Agreement is concluded on behalf of a legal entity, the person concluding the Agreement acknowledges, declares and undertakes that they are authorised to perform such a transaction on behalf of the said legal entity; otherwise (in the case of an unauthorised transaction), they shall be personally liable for all subsequent legally binding transactions.
The Member agrees that, from the moment they begin using the Site, they shall be deemed to have accepted all terms of the Agreement and that these terms shall be binding upon them. The provisions of this Agreement shall also be binding upon visitors who are not Members but make limited use of and/or visit the Site. Infofluencer reserves the right to modify the conditions specified below at its discretion when required by law or this Agreement, and to notify the Member of any changes.
2. RIGHTS AND OBLIGATIONS OF THE MEMBER
The Site is open to use by everyone.
The Member acknowledges, declares and undertakes that they will act in accordance with all the conditions in the Agreement and all the rules specified in the relevant sections of the Site when using the Site.
The Member acknowledges and undertakes that they will under no circumstances share their personal information related to membership with any third party. Otherwise, the Member acknowledges, declares and undertakes that they shall be obligated to compensate Infofluencer for any damages arising from this without prior notice and immediately. The Member acknowledges, declares and undertakes that they will not give the password they have set to other persons or organisations and that the rights of use granted under this Agreement belong solely to them and cannot be transferred to others. Otherwise, the Member shall be held responsible for the use of such information by third parties and any resulting damages.
While using the services offered on the Site, the Member agrees to comply with the Code of Obligations, the Turkish Penal Code, the Turkish Commercial Code, the Law on Intellectual and Artistic Works, the Law on the Protection of Trademark and Patent Rights, Decree-Laws and other relevant legislation, as well as any announcements and notifications Infofluencer may publish regarding its services. The Member shall bear all legal, criminal and financial responsibility arising from any use contrary to these notifications and laws.
The Member shall fully and immediately compensate Infofluencer for any damages arising from acts contrary to the obligations undertaken in this Agreement; Infofluencer reserves the right of recourse against the Member for any compensation, administrative/judicial fines that it may have to pay to public authorities and/or third parties due to the Member's actions in breach of the Agreement.
The Member may not engage in actions that prevent or hinder other members and visitors from using the Site; may not load and lock servers or databases with automated programs; may not attempt to manipulate data; otherwise, the Member acknowledges that their membership shall be terminated by Infofluencer and that they shall bear all legal and criminal responsibility arising from this situation.
Backing up correspondence within the Site is the responsibility of the individuals and is recommended by Infofluencer. Infofluencer cannot be held responsible for the loss or deletion of correspondence due to the failure to back it up.
If the Member does not request otherwise, Infofluencer is free to delete or retain any record relating to a membership account terminated by Infofluencer or by the Member themselves, within the framework of Law No. 6698 on the Protection of Personal Data. In the absence of any request from the Member, if Infofluencer deletes the records relating to the Member within the framework of Law No. 6698, the Member may not claim any rights or compensation regarding the deleted records. The Member's rights under Law No. 6698 are reserved.
The Member accepts that the personal and other information provided when registering on or using the Site is correct. Although Infofluencer takes all reasonable measures to verify the accuracy of the personal and other information provided by the Member, the Member acknowledges, declares and undertakes that, in the event such information is inaccurate, they will immediately compensate Infofluencer for any damages arising as a result. The Member also acknowledges, declares and undertakes that they will update such information immediately in the event of any change, and within any timeframe set by relevant legislation.
Risks associated with links (connections directing to other websites) provided on the Site for the information and convenience of visitors lie with the Member. Infofluencer includes such links on the site and/or in its content solely to provide information and convenience to visitors.
The visual and written content provided on the Site is for personal use. All rights to the texts, graphics, photographs, videos, animations and sounds in the Site's content are reserved; unless otherwise stated, they may not be used for commercial or personal purposes without permission. It is forbidden to publish or link to any element on the Site on another medium or website without Infofluencer's permission and approval.
The Member may in no way use, resell, share, distribute, display, copy, reproduce, process or prepare derivative works from Infofluencer's copyrighted works on the Site. Otherwise, the Member declares, accepts and undertakes that they shall be responsible for all damages incurred or that may be incurred by Infofluencer.
Copying or using the software whose rights belong to Infofluencer and which is used in the design of pages and the creation of databases is strictly prohibited.
3. RIGHTS AND OBLIGATIONS OF INFOFLUENCER
In the cases specified below, in addition to all rights arising from the law, Infofluencer reserves the right to cancel transactions, temporarily or permanently suspend the service offered, suspend the Member's use and/or block their access without specifying a reason, terminate the Member's membership, and unilaterally and immediately terminate this Agreement:
- If incorrect, irregular, incomplete or misleading information, expressions contrary to general moral rules, or information not in accordance with the laws of the Republic of Türkiye is recorded on the Site;
- If the works and data on the Site are copied and used, or attempted to be used, in part or in whole;
- If software that may threaten the general security of the Site or impair the operation of the Site and the software used is employed; if such activities are carried out or attempted; or if information is obtained, deleted or modified;
- If Infofluencer detects that the Member has caused harm to Infofluencer, obtained an unfair advantage or carried out repeated practices by exploiting any vulnerability (technical etc.) of Infofluencer's campaigns, sales system or the Site, thereby misusing the sales system or the Site;
- If the Member acts contrary to all the conditions in the Agreement, the rules specified in the relevant sections of the Site, and applicable legislation when using the Site or making purchases.
If the rights of use of information such as username and password granted to Members by Infofluencer for membership of the Site or determined by them are shared with third parties, the Member shall be directly responsible for the malicious use of their password by other persons. Likewise, the Member may not use someone else's IP address, email address, username or other information on the internet, and may not access or use the private information of other Members without permission. All legal and criminal liability arising from such use rests with the Member.
4. PRIVACY AND PROTECTION OF PERSONAL DATA
Infofluencer attaches great importance to the privacy rights of its customers and the protection of their personal data, and complies with the legal regulations on the Protection of Personal Data. You can find detailed information regarding the processing of your personal data by Infofluencer in the Privacy Notice publicly shared on our website.
5. DURATION AND ENTRY INTO FORCE OF THE AGREEMENT
This Agreement, concluded by the parties, has been concluded at the moment the Member becomes a member and has entered into force indefinitely for both parties. It shall automatically become null and void without any need for notice in the event of breach of and/or termination of this Agreement, or any termination of membership for any reason. The Member acknowledges in advance that Infofluencer may, when it deems necessary, cancel Site membership and terminate this Agreement.
In order to ensure the continuity of the services it provides, Infofluencer may make unilateral changes to this Agreement at any time without prior notice. Provided that the ultimate purpose of the Site and the services it offers remain essentially the same, Infofluencer reserves the right, at any time and without giving any reason, to unilaterally and continuously or temporarily suspend the service it provides, change or cancel the content of the service, including prices published on the Site. If Infofluencer deems it necessary, it shall publish updated membership terms on the Site under the same link, together with the date of update, and may notify the Member. Updated membership terms shall be effective from the moment they are published on the Site, and use of the Site or services shall thereafter be subject to the new membership terms.
Different rules and obligations specific to the relevant section may be set in certain parts of the Site. The Member who uses these sections is deemed to have read and accepted the relevant rules.
The validity, interpretation and performance of this Agreement are subject to the laws of the Republic of Türkiye. Istanbul Central (Çağlayan) Courts and Enforcement Offices have jurisdiction over the resolution of disputes that may arise from the application of this Agreement.
6. COMMUNICATION AND OTHER PROVISIONS
If a Member chooses to opt out of e-bulletin or SMS membership at any time, they may unsubscribe by sending a notification to Infofluencer's email address destek@infofluencer.co stating, "I do not wish to be informed of announcements."
Infofluencer's contact information is as follows; the Member's legal notification address is taken to be the address declared at the time of becoming a member. Unless the Member notifies Infofluencer in writing of any changes to their declared address within 3 (three) days, the Member acknowledges and declares that notifications sent to the addresses on file at Infofluencer shall be valid and deemed to have been served. Communication via the email address declared by the Member at the time of membership does not negate this. Furthermore, any notification that Infofluencer sends to the Member's email address registered in the system pursuant to this Agreement is accepted as valid by the parties, and the parties accept that the notification sent via email has been served on the Member.
MEMBER ACCEPTANCE AND CONSENT DECLARATION
I accept that I am a party to this Agreement and further declare and undertake that I have read and understood the matters stated above and that I will act in accordance with my obligations. Otherwise, I accept and undertake that I will immediately fulfil all of Infofluencer's claims and pay for all damages it incurs.
